The TIEA was signed on February 4, 2011. In India, the TIEA applies to all taxes, and in the IoM, taxes on income or profit. The TIEA provides for the exchange of information relevant to the administration and enforcement of domestic tax laws, and to the determination, assessment and collection of taxes, the recovery and enforcement of tax claims, or the investigation/prosecution of tax matters. The TIEA also provides for the exchange of information held by banks and other financial institutions, and information regarding the ownership of partnerships, companies, collective investment funds or schemes, trusts and foundations.


Treaty Update: India - Colombia

Dividend withholding tax will be charged at 5%. Interest and royalties will be subject to 10% tax. Profits derived from construction, assembly or installation projects lasting at least six month will be taxed in the source state. Business profits are to be taxable in the source country if such a business is classified as a permanent establishment in that state. Profits derived by an enterprise from the operation of ships or aircraft in international traffic shall be taxable in the country of residence. Capital gains from the sale of shares will be taxable in the source country. The DTA also provides for the exchange of information.
